1ABOUT THESE TERMS

“These Terms and Conditions (Terms) form a legally binding User Agreement between you (“User”, “You”) and Miyraa (“Company”, “We”, “Us”, “Our”).

By creating an account, accessing, or using any part of Miyraa, you agree that you have read, understood, and accepted these Terms. If you do not agree with these Terms, you must not use Miyraa.

These Terms apply to all users including adults, minors, parents, guardians, creators, influencers, businesses, advertisers, and any person accessing Miyraa.

“Miyraa is an identity-first, child-safety focused, emotionally intelligent social networking platform operated by Miyraa Pvt. Ltd, registered in India, Andhra Pradesh.

The registered office address will be updated at the time of official publication.”

• The platform includes:
• identity verification mechanisms
• face detection + face protection
• AI emotional signals
• deepfake security
• parental controls
• creator tools
• business features
• ad system

All usage is subject to these Terms.

3ACCEPTANCE OF TERMS

• You accept these Terms by:
• creating an account
• using the app
• accessing any feature
• posting content
• interacting with others

Your continued use constitutes implied acceptance of updated Terms.

4AGE REQUIREMENTS

Adults

Age 18+ users may use Miyraa independently.

Minors (13 to 17)

• Minor accounts must be:

linked to a verified parent or guardian

• monitored by parent settings
• controlled under parental supervision
• restricted according to child safety rules

Minors cannot disable parental controls.

Children below legal age

If your jurisdiction prohibits children under a certain age (e.g., COPPA under 13), those users are not permitted to independently use Miyraa.

5REAL IDENTITY AND VERIFICATION

Mandatory real identity

Verification methods may include:

• Government-issued ID
• Selfie verification
• Face scan
• Liveness detection
• Device authentication

You must:

• provide accurate information
• update details when required
• not impersonate others
• not create fake accounts
• not create accounts for bots

Miyraa may require periodic re-verification of identity for security, safety, or compliance purposes.

Failure to complete re-verification may result in temporary or permanent restriction of the account.

6BIOMETRICS & FACE PROTECTION

Withdrawal of biometric consent may disable related features.

Ownership of Face and Likeness

Users retain full ownership and individual rights over their own face, appearance, biometric identity, likeness and any facial representation within the Services. No user, creator or third party may use,

upload, edit, reproduce, distribute, manipulate or publish another person’s face, likeness, image or biometric data without that person’s prior consent.

Miyraa reserves the right to block, remove or restrict any content that misuses or exploits another user’s face or identity, and may take enforcement actions including account restrictions,

content removal, legal notification or reporting to authorities where required.

Any unauthorized use of another person’s face, likeness or visual identity constitutes a violation of these Terms, and Miyraa may take immediate action including content removal,

account suspension, permanent termination, IP blocking, legal notices or escalation to law enforcement where applicable.

Users may request removal, takedown or restriction of any content containing their face or likeness at any time, and Miyraa will make reasonable efforts to process such requests promptly, subject to legal, investigative or safety requirements.

Miyraa may retain limited copies of such content for legal, safety or evidence purposes where required by law or necessary to comply with law enforcement requests.

Biometric data will never be sold, rented, or shared for advertising, profiling, or third-party marketing purposes.

7DEEPFAKE IDENTIFICATION & MEDIA SECURITY

• We may:
• flag suspicious content
• restrict sharing
• request verification
• remove harmful media

8MINOR SAFETY & PARENTAL CONTROL

All minor accounts:

• require parent approval
• cannot delete history without parent visibility
• cannot access certain content
• are monitored using AI

Parents may:

• view minor settings
• restrict features
• report questionable activity
• request account removal

Any attempt by an adult to contact, groom, influence, or manipulate a minor may result in immediate termination and reporting to authorities.

9AI EMOTIONAL INTELLIGENCE (EIS)

• Miyraa uses AI to:
• adjust interface visuals
• reduce harmful content exposure
• detect emotional patterns
• assist emotional safety
• This is not medical advice

10PROHIBITED CONTENT

• Users may NOT post:
• adult sexual content
• child sexual material
• threats or violence
• harassment
• bullying
• hate speech
• extremist content
• non-consensual intimate images
• deepfakes causing harm
• impersonation
• illegal activity
• scams
• harmful psychological content

11USER RESPONSIBILITY

• You agree that:
• you are responsible for your actions
• you must respect others
• you must follow applicable laws
• you must not harm minors
• you must not harass others

12COMPANY RIGHTS

• We may:
• remove content
• limit reach
• disable accounts
• suspend features
• apply restrictions
• report to authorities
• cooperate with law enforcement

at our discretion.

Miyraa retains the unilateral right to decide what constitutes a safety risk, emotional risk, or legal violation.

Miyraa does not obligate users to create content, maintain engagement, respond to prompts, or modify behavior for algorithmic visibility, ranking, or commercial optimization. User wellbeing, dignity, and autonomy take precedence over engagement metrics.

13BUSINESS & ADVERTISING

• Businesses must verify:
• registered name
• address
• documents
• legal identity
• Ads must follow rules:
• no adult content
• no scams
• no harmful products
• no illegal items
• no political misuse
• Miyraa may reject ads anytime

14CREATOR ACCOUNTS

• Creators must:
• disclose sponsorships
• avoid harmful promotions
• follow legal rules
• follow ad policies

Violation = removal + payment freeze.

15INTELLECTUAL PROPERTY

All Miyraa design, branding, code, trademarks, and content belong to the Company.

Users retain ownership of their posted content but grant Miyraa a license to display it.

16TERMINATION OF ACCOUNT

We may terminate, suspend or restrict accounts due to:

• policy violations
• safety concerns
• identity misuse
• child safety issues
• legal reporting
• harassment
• fraud
• deepfake misuse

17LEGAL LIMITATION OF LIABILITY

• Miyraa is not responsible for:
• user actions
• harmful behavior of others
• emotional effects
• external content
• psychiatric impact
• content accuracy
• psychological outcomes

Users understand that all interactions on Miyraa occur at their own risk, and Miyraa is not responsible for the conduct of other users.

18NO PROFESSIONAL ADVICE

• Miyraa is NOT:
• medical service
• psychological service
• emergency service

19GOVERNING LAW & JURISDICTION

Primary Jurisdiction (India)

These Terms are primarily governed by and interpreted in accordance with the laws of India, except where a different law is mandatorily applicable to users located in another country.

International Users

In such situations, Miyraa will comply with the mandatory laws of that jurisdiction, to the extent required.

Dispute Resolution

All disputes must first be attempted to resolve through:

• internal support channels
• mediation
• online dispute resolution (ODR)

before going to courts.

Courts & Legal Enforcement

Legal cases shall be subject to the competent courts of Hyderabad / Andhra Pradesh, India, unless otherwise required by mandatory local law applicable to that specific user.

International Compliance

The platform intends to comply with applicable regulations in:

• India (IT Act, POCSO)
• EU (GDPR)
• US (COPPA/CCPA when applicable)

Users located in the United States or within the European Union may also have specific statutory consumer rights, privacy protections,

data subject rights or mandatory dispute resolution procedures under relevant national or regional laws. Nothing in these Terms is intended to override or waive mandatory rights provided under applicable law in such jurisdictions.

20CHANGES TO TERMS

We may update these Terms periodically and notify users where required.

Miyraa may modify, suspend or discontinue any feature or functionality at any time for operational, security or legal reasons without prior notice.

Miyraa may limit visibility or discoverability of any content based on safety, legal compliance or community guideline enforcement.

Users are responsible for ensuring they have the necessary rights to upload and share any content on the Services.

Screenshots or screen recordings of Miyraa content are also subject to these Terms and may not be used without authorization.

Continued use of the Services after such updates constitutes acceptance of the revised Terms.

22PLATFORM OWNERSHIP & RESERVATION OF RIGHTS

Ownership of Services

All rights, title, and interest in and to the Miyraa platform, including but not limited to the application, interface, software, algorithms, AI systems,

facial recognition modules, biometric models, emotional intelligence technology, designs, logos, trademarks, Service features,

content moderation systems and all other related intellectual property, are and shall remain the exclusive property of Miyraa and/or its licensors.

No Transfer of Ownership

Nothing in these Terms shall be interpreted as transferring any ownership, intellectual property rights, proprietary technologies,

or operational control to any user or third party. Access to the Services constitutes a limited, revocable permission to use the platform in accordance with these Terms only.

Reservation of Rights

All rights not expressly granted to users are reserved by Miyraa.

Miyraa retains exclusive control, authority and discretion over all platform operations, content moderation, feature deployment,

feature discontinuation, interface decisions, security measures, AI implementation and enforcement of these Terms.

Platform Decisions

Miyraa may exercise exclusive decision-making rights in matters related to:

• content filtering and visibility,
• user verification,
• safety interventions,
• identity validation,
• parental controls,
• biometric protections,

suspension or removal of content or accounts,

• AI-based moderation or detection,
• legal escalations,

cooperation with authorities.

Users have no claim, challenge, reimbursement or demand against Miyraa regarding such decisions.

Miyraa may deny access to any user, device or account at any time for safety, legal or security reasons without prior notice.

Users have no ownership, decision-making authority, or operational influence over the Miyraa platform, its algorithms, or moderation processes.

23USER LICENSE & PERMITTED USE

Limited License

Subject to these Terms, users are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal,

lawful, non-commercial purposes unless expressly authorized under business or creator accounts.

Restrictions

• Users shall not, directly or indirectly:

copy, modify, reverse engineer or decompile any part of the Services

• attempt to extract source code

create derivative works of any Miyraa technology

circumvent access controls, safety mechanisms or identity systems

use Miyraa for scraping, automated extraction, bots or data harvesting

use another person’s face, identity or biometric data without consent

Users may not interfere with the security, integrity or performance of the Services.

No Implied Rights

No rights are granted to users except those explicitly stated in these Terms.

24USER OBLIGATIONS & RESPONSIBILITIES

• Users must:
• comply with all applicable laws
• not harm minors or vulnerable individuals

not engage in harassment, deepfake misuse or abuse

• respect face protection rules
• respect parental control systems
• maintain truthful identity information
• ensure lawful ownership of uploaded content
• comply with community guidelines

Failure to comply constitutes a violation and may lead to suspension or legal action.

25PROHIBITED BEHAVIOR (DETAILED)

• Users must not:
• impersonate other individuals
• bypass identity verification
• falsify government documents
• misuse another person’s biometric data

engage in stalking, harassment, bullying, threats or intimidation

generate deepfake or morphed content using another person’s likeness

publish harmful or non-consensual images of others

• violate child protection standards

upload illegal or exploitative content.

26CHILD SAFETY ENFORCEMENT (DETAILED)

Parental Oversight

All minor accounts remain subject to parental review and settings. Parents may access certain account controls, settings and safety alerts as permitted under applicable law.

Prevention & Monitoring

Miyraa may use automated and manual systems to detect harmful content, grooming behavior, suspicious interactions, or patterns of exploitation affecting minors.

Mandatory Reporting

Where required by law (such as India’s POCSO, IT Act, or applicable international law), Miyraa may report suspected child exploitation, sexual content involving minors, trafficking, grooming or abuse to:

• law enforcement,
• cyber crime authorities,

Immediate Action

• Miyraa may immediately:
• disable accounts,
• remove content,
• block access,
• escalate to police,
• retain evidence,
• restrict communication,

where minors are at risk.

27MANDATORY POLICE & LEGAL COOPERATION

Legal Obligation

Miyraa may cooperate with authorized law enforcement requests, court orders or government directives where required under applicable law.

Evidence Retention

Miyraa may preserve data, images, screenshots, logs, messages, posts or biometric evidence necessary for:

• criminal investigation,
• cyber protection,
• child safety cases,

legal authority requests.

User Notification

Where required or permitted by law, Miyraa may notify users of such actions. In sensitive cases involving minors or safety concerns, notification may be restricted.

28EVIDENCE STORAGE & DATA PRESERVATION

Preservation Rights

Miyraa may retain content or account data even after deletion by the user, when necessary for:

• legal compliance,
• police cases,
• internal investigations,
• safety audits,

dispute resolution.

No Liability for Retention

Users agree that such retention is lawful and required for safety and legal reasons.

Miyraa is not required to disclose investigative details, internal reports or reasons for enforcement actions when doing so could compromise safety, legal obligations or ongoing investigations.

Miyraa may share information with relevant authorities in matters involving threats, harm, terrorism, stalking, harassment or potential criminal behavior.

29INDEMNIFICATION

User Responsibility

Users agree to defend, indemnify and hold harmless Miyraa, its founders, directors, officers, employees, agents, affiliates,

contractors and service providers from and against any claims, damages, losses, liabilities, penalties, legal costs or expenses arising from:

• user content
• misuse of Services
• violation of these Terms

unauthorized use of another person’s identity, face or biometric data

• harassment, abuse or harmful behavior
• illegal content or activity
• breach of intellectual property rights
• violation of child protection laws

any legal dispute caused by the user

Costs

Indemnification includes compensation for applicable legal fees, attorney fees, investigation costs and court expenses.

Third-Party Claims

Users shall remain fully responsible if another user, third-party or legal entity files a complaint or legal action arising from the user’s behavior on the Services.

Control of Defense

Miyraa reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user,

in which case the user agrees to cooperate fully with Miyraa in asserting any available defenses.

Users agree not to hold Miyraa liable for actions taken in good faith to enforce safety, emotional wellbeing, or legal compliance.

30DISCLAIMER OF WARRANTIES

As-Is Basis

The Services are provided “as-is” and “as available” without warranties of any kind, express or implied.

No Guarantee

Miyraa does not guarantee that the platform will be:

• uninterrupted
• error-free
• secure
• free from harmful content
• continuously available
• permanently stored

No Professional Advice

• Miyraa does not provide:
• medical,
• mental health,
• psychological,
• legal,
• safety,

or crisis counseling advice.

Users should contact professional services in emergency situations.

No Guarantee of Content Accuracy

Miyraa does not warrant the accuracy, completeness, reliability or usefulness of any content, information or materials made available through the Services, whether generated by Miyraa, users, advertisers or third parties.

No Duty to Monitor

Miyraa has no general obligation to monitor user activity or pre-screen content and does so at its discretion for safety and legal compliance purposes only.

31LIMITATION OF LIABILITY

Limited Liability

To the maximum extent permitted by law, Miyraa shall not be liable for:

• lost profits
• reputational damage
• data loss
• deletion of content
• unauthorized access by others
• cyber attacks
• emotional harm
• misuse by other users
• content posted by others

No Indirect Damages

• Miyraa is not liable for:

Maximum Liability

In any event, Miyraa’s total liability shall not exceed the amount (if any) paid by the user for using the Services in the last 12 months.

Non-Excludable Rights

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law, such as liability for fraud, wilful misconduct or, where applicable, death or personal injury caused directly by Miyraa’s gross negligence.

Miyraa is not liable for any loss arising from reliance on emotional signals, AI suggestions, or interface changes.

32DELETION OF CONTENT & ACCOUNT DATA

User Deletion

User deletion requests may permanently remove certain data, subject to evidence retention and legal requirements.

Platform Deletion

Miyraa may delete or remove content at any time for:

• safety
• legal
• privacy
• policy enforcement
• minors protection
• security reasons

Backup & Copies

Deleted content may remain in secure backups for legal, investigative or operational purposes.

33EMERGENCY & SAFETY SITUATIONS

Threats & Harm

Miyraa may take immediate action in cases involving threats, suicide, self-harm, violence, harassment, manipulation or endangerment.

Safety Interventions

• contacting emergency services
• reporting to authorities

Crisis Support

Users experiencing emergencies should contact local authorities or emergency services. Miyraa cannot guarantee immediate support or intervention.

Miyraa may take action even based on suspicion when urgent safety risks are detected.

34THIRD-PARTY LINKS & SERVICES

Miyraa may contain content, services or features operated by third parties. Miyraa is not responsible for:

Third-Party Transactions

35ADVERTISEMENTS & COMMERCIAL CONTENT

Advertisers are solely responsible for the accuracy of their ads and promotional materials.

No Liability

Removal

Miyraa may reject, remove or restrict ads at its discretion without explanation.

Authority to Bind

Where a user creates or manages a business or brand account, the user represents and warrants that they are duly authorized to act on behalf of that business or organization and to bind it to these Terms.

Miyraa Ownership

• algorithms
• UI/UX design
• features
• logos

are the exclusive property of Miyraa.

User Restrictions

• Users shall not:

• attempt to obtain source code
• create derivative works
• translate, lease or distribute Miyraa technology
• use Miyraa to build competing services

Enforcement

• Miyraa may take legal action including:
• content removal
• access blocking
• account termination

IP Complaints

If you believe that any content on the Services infringes your copyright, trademark or other intellectual property rights,

you may notify Miyraa through the designated contact channel with sufficient details for identification and review.

Miyraa may remove or restrict access to allegedly infringing content and may, in appropriate circumstances, terminate repeat infringers.

All rights not expressly granted to users are reserved by Miyraa, including all future, potential or undeveloped rights in the Services or technology.

40CHILD SAFETY & AGE REQUIREMENTS

Misrepresentation of Age

Miyraa may restrict, suspend or remove any account where age or identity information is falsified or cannot be reliably verified, particularly where child safety concerns exist.

41SUSPENSION & TERMINATION

Grounds for Suspension

Miyraa may suspend or terminate accounts for:

• violation of Terms
• illegal activity
• privacy violations
• safety risks
• threats
• harassment
• misuse of identity or biometric data

Immediate Action

Miyraa may take immediate action without notice for urgent safety or legal reasons.

Effect of Termination

Upon termination or suspension, users lose access to the Services and their account.

Certain information may be retained by Miyraa for legal, safety, audit or evidence purposes, in accordance with these Terms and applicable law

. Miyraa shall have no obligation to provide copies of content or data after termination, except where mandated by law.

Users acknowledge and agree that suspensions or terminations may occur without prior notice and that Miyraa shall not be liable for any damages, losses, data loss or claims arising from such actions, except where legally required.

42FORCE MAJEURE

Miyraa shall not be liable for delays or failures caused by events outside reasonable control including:

• natural disasters
• cyber-attacks
• network failures
• government actions
• war or emergency situations

All rights not expressly granted to users are reserved by Miyraa.

43CREATOR POLICY

Eligibility

Creator Responsibilities

Enforcement

Miyraa may at any time restrict, remove or disable content that:

violates advertising laws.

Disclosure of Sponsored Content

Creators are responsible for clearly disclosing any paid partnerships, sponsorships,

gifted products or other material connections in accordance with applicable advertising,

No Employment Relationship

Nothing in these Terms or in any creator or monetization feature shall be construed as creating an employment,

partnership, joint venture or agency relationship between Miyraa and any creator. Creators act in their own independent capacity.

44BUSINESS POLICY

Business Accounts

Organizations, brands, and companies may maintain business accounts for:

• content,
• promotions,
• marketing,
• communication,

brand representation.

Verification

• Businesses may be required to provide:
• legal documents,
• registration details,
• trademarks,
• identity proofs,

legal authorization.

Miyraa may suspend accounts where verification fails or appears false.

No Legal Warranty

Miyraa does not guarantee business outcomes, financial success, or results from commercial content.

Customer Relationships

Any sales, offers, promotions or transactions between a business account and its customers are solely between those parties.

Miyraa is not a party to such transactions and is not responsible for refunds, product quality, delivery, service performance or disputes between businesses and their customers.

45ADVERTISING POLICY

Ad Submission

• Advertisers are solely responsible for:

• disclosures,
• targeting,

compliance with regional advertising laws.

Prohibited Advertising

• Ads may not include:

• adult exploitation,

Miyraa is not obligated to approve any advertisement.

Advertiser Liability

Advertisers remain fully liable for legal compliance and claims arising from ads.

Miyraa is not responsible for advertiser statements.

Labeling and Ranking

Miyraa may label certain content as “sponsored”, “paid partnership” or similar, and may determine the placement, ranking and frequency of advertisements at its sole discretion.

Advertisers and creators have no guarantee of impressions, reach, clicks or results.

Restricted Categories

Miyraa may ban or restrict advertising in sensitive categories including, without limitation, adult content, gambling, illegal drugs,

dangerous products, misleading financial schemes, hate or extremist content and any category restricted under applicable law.

Miyraa may modify, pause, or revoke any monetization or advertising feature at any time without liability.

46MONETIZATION POLICY

Eligibility

Revenue Sharing

Payouts

• Creators are responsible for:
• tax compliance,
• bank information,
• payout accuracy,

reporting requirements.

• Miyraa may delay payouts for:
• safety,
• legal investigation,
• fraud checks,

identity verification.

Withholding and Clawback

Miyraa may withhold, delay or reverse (claw back) any payouts where it reasonably suspects fraud, policy violations, chargebacks, unlawful activity, identity issues or reporting errors.

Users agree to return any amounts paid in error or obtained in violation of these Terms.

No Guarantee of Monetization

Miyraa does not guarantee that any user, creator or business will be eligible for monetization, will remain eligible, or will earn any particular amount.

Monetization programs, eligibility criteria and revenue shares may be changed, suspended or discontinued at any time.

Miyraa may modify, pause, or revoke any monetization or advertising feature at any time without liability.

• Creators and businesses agree that Miyraa:
• is not responsible for business outcomes,
• does not guarantee visibility,
• does not guarantee views,
• does not guarantee income,

is not obligated to promote or feature content.

48COMMERCIAL USE RESTRICTIONS

Users shall not use the Services for:

• illegal financial activity,
• unlicensed medical services,
• adult exploitation,
• political manipulation,
• impersonation,
• identity fraud,

biometric misuse.

Miyraa may report violations to authorities.

49DATA FOR COMMERCIAL USE

Business or creator accounts agree that their interactions may be used by Miyraa for:

• analytics,
• metrics,
• security evaluation,
• algorithmic performance,
• advertising relevance,

as permitted by law.

Additional Provisions

All rights not expressly granted to users, creators, advertisers or businesses are reserved by Miyraa.

Revenue shares, criteria, payout methods, currencies, and region availability may change at any time without notice.

Business or monetization features may be changed, removed, limited, or discontinued globally or regionally without prior notice.

Failure to properly disclose sponsorships may result in suspension or removal from monetization or advertising features.

Business accounts may be suspended if legal verification fails or if the business operates illegally.

These provisions survive termination of any account and apply to all past and future conduct.

By using Miyraa, you acknowledge that facial detection may occur automatically to identify safety or misuse situations.

We may automatically restrict or remove suspected deepfake media without user request.

Miyraa may remove content that negatively impacts emotional wellbeing, even if not illegal.

Any suspected child exploitation results in immediate escalation to legal authorities where required.

Miyraa may deny, limit, or remove access to any feature, service, or tool at any time for any reason related to safety, legal compliance, platform integrity, or operational needs.
